引言: 經由15年來不間斷的修改商擬，中國大陸終於2007年8月30日正式通過「反壟斷法」並於2008年8月1日生效，期待透過此法強化自1993年以來所建制競爭法規範，並完善社會主義市場經濟體制與維護自由與公平競爭秩序，可謂里程碑之重點法律。我國並無所謂的「反壟斷法」，相關商業競爭等法條則係由公平交易法來規範。其中部份內容實與中國大陸的「反壟斷法」相當雷同。

本文除概略介紹中國大陸新實施的「反壟斷法」外，並進一步的將其與我國公平交易法作概略的比較。
